This website is operated by EXCLUSIVE CARBON CASE d.o.o.. Throughout the website, the terms “we”, “us” and “our” refer to EXCLUSIVE CARBON CASE d.o.o.
By using this website and/or purchasing our products, you agree to these Terms and Conditions, as well as any additional rules and policies referred to on the website or made available through links.
Important: Please read these Terms carefully before using the website or making a purchase.
Any new features or services subsequently added to the online store will also be subject to these Terms.
SECTION 1 – ONLINE STORE TERMS
To use this website independently, you must be of legal age under the laws of the country in which you reside. Minors may use the website only with the consent of a parent or legal guardian.
Our products and website may not be used for unlawful purposes or in any manner that violates applicable laws.
The transmission of viruses, malicious code or other content that could compromise the security of the website is strictly prohibited.
SECTION 2 – GENERAL CONDITIONS
We reserve the right to refuse or limit an order where permitted by law, particularly in cases of suspected misuse, fraud, inaccurate information or other circumstances that may prevent the proper fulfilment of an order.
You may not copy, resell or commercially exploit the content of this website or any part of it without our prior written permission.
SECTION 3 – ACCURACY OF INFORMATION
We make every reasonable effort to ensure that the information published on our website is accurate, complete and up to date.
However, unintentional errors or omissions may occur. We reserve the right to correct such errors as soon as they are identified.
Information that we are legally required to provide to consumers before entering into a contract will be provided in accordance with applicable law.
SECTION 4 – PRICES
Product prices are displayed on the website alongside the relevant product or, in the case of products made according to the individual requirements of the customer, determined according to the selected configuration and order specifications.
Prices may change without prior notice. However, a price change after an order has been confirmed will not affect an order that has already been confirmed.
Product prices are not automatically personalised for individual customers on the basis of their personal data or behaviour on the website.
Any additional costs that can reasonably be calculated in advance will be displayed to the customer before the final confirmation of the order.
SECTION 5 – PRODUCTS AND SERVICES
Certain products may be available exclusively through our online store and may be available in limited quantities.
Most AccordCase products are manufactured after an order has been received, according to the customer’s specifications, selections and individual requirements. Depending on the product, the customer may select the model, dimensions, colour, finish and other characteristics.
Products in the OUTLET category are generally pre-manufactured products that have not been made according to the individual specifications of a particular customer.
We make every reasonable effort to display product colours, materials and appearance as accurately as possible. However, the appearance may vary depending on the settings of the customer’s screen or device.
We reserve the right to discontinue individual products or limit their availability.
SECTION 6 – ORDERS AND BILLING INFORMATION
The customer must provide accurate, complete and up-to-date information required for processing the order, payment and delivery.
We reserve the right to refuse or limit an order where there are justified reasons, including inaccurate information, inability to fulfil the order or suspected misuse.
Available payment methods will be displayed to the customer during the ordering process.
SECTION 7 – PRODUCTION AND DELIVERY
Our products are handmade.
The expected production and delivery time is generally 15 to 60 days, depending on the type of product, its specifications and the individual requirements of the order.
Delivery costs, where applicable, will be shown to the customer before final confirmation of the order.

SECTION 8 – RIGHT OF WITHDRAWAL
OUTLET products
For products from the OUTLET category that are pre-manufactured and have not been made according to the individual specifications of the customer, a consumer has the right to withdraw from a distance contract, without giving any reason, within 14 days from the date on which the product is received.
To exercise the right of withdrawal, the consumer must notify us of their decision before the expiry of the 14-day period.

The consumer does not need to provide a reason for the withdrawal.
The consumer must return the product without undue delay and no later than 14 days from the date on which they informed us of their decision to withdraw from the contract.
The direct cost of returning the product is borne by the consumer.
In the event of a valid withdrawal, we will reimburse the payments received from the consumer without undue delay and within the period prescribed by applicable law.
We may withhold reimbursement until the product has been returned to us or until the consumer provides evidence that the product has been sent back, whichever occurs first.
The consumer is responsible for any reduction in the value of the product resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.
Products made to the customer’s specifications
The 14-day right of withdrawal does not apply to products made to the customer’s specifications or products that are clearly personalised for the customer.
This applies to AccordCase products manufactured after an order has been received on the basis of the customer’s individual selections, specifications or requirements.
This exclusion from the right of withdrawal does not affect the consumer’s statutory rights in the event of a material defect, a defective product or a product that has not been delivered in accordance with the order.
SECTION 9 – MATERIAL DEFECTS AND CLAIMS
EXCLUSIVE CARBON CASE d.o.o. is liable for material defects in accordance with the applicable laws of the Republic of Croatia.
To enable us to resolve claims as quickly as possible, we ask customers to report visible defects, damage or incorrectly delivered products within 8 calendar days of receiving the product.

The 8-day period is a recommended period for the prompt handling of claims and does not limit the consumer’s statutory rights arising from liability for material defects.
Statutory liability for material defects applies in accordance with applicable law, including the prescribed minimum liability period of two years for consumer contracts.
In the event of a justified claim, the consumer is entitled to the remedies provided by applicable law, including, depending on the circumstances and statutory conditions, repair or replacement of the product, a price reduction or termination of the contract.
SECTION 10 – DAMAGE DURING DELIVERY
The customer should inspect the external condition of the shipment upon delivery.
If there is visible damage to the packaging, we ask the customer to immediately report it to the carrier and, where possible, photograph the damage.
If the customer refuses to accept a shipment due to visible damage, the appropriate carrier damage report should be completed and we should be notified at:

SECTION 11 – WRITTEN CONSUMER COMPLAINTS
Consumers may submit a written complaint:

We will confirm receipt of the written complaint without undue delay.
We will respond to the written complaint in writing no later than 15 days from the date of receipt, clearly stating whether we accept the complaint as justified.
Records of written complaints are maintained and retained in accordance with applicable law.
SECTION 12 – ALTERNATIVE DISPUTE RESOLUTION
If the consumer is not satisfied with our response to a written complaint, the consumer may initiate an alternative consumer dispute resolution procedure before one of the competent alternative dispute resolution bodies in the Republic of Croatia.
Information about competent bodies and procedures for initiating alternative dispute resolution is available on the official websites of the relevant Croatian authorities.
SECTION 13 – WARRANTIES AND AFTER-SALES SERVICES
The consumer’s statutory rights relating to material defects are exercised in accordance with the applicable laws of the Republic of Croatia.
If an additional commercial warranty applies to a particular product, its terms and duration will be clearly stated alongside the product or in the accompanying documentation.

We may provide access to certain tools or services provided by third parties.

We are not responsible for the content, products, services or business practices of third-party websites. We recommend reviewing their terms and privacy policies before using their services.
SECTION 16 – USER COMMENTS AND CONTENT
If users voluntarily provide us with ideas, suggestions, feedback or other content, such content must not infringe the rights of third parties or contain unlawful or harmful material.

SECTION 17 – PERSONAL DATA
The collection and processing of personal data are governed by our Privacy Policy.
Information required for order processing, payment, delivery and communication with the customer is processed in accordance with applicable data protection laws.
SECTION 18 – ERRORS AND OMISSIONS
We may correct errors or inaccuracies in product descriptions, prices, promotions, availability or other information.
If an error affects an order that has already been submitted, we will inform the customer and proceed in accordance with applicable law.
SECTION 19 – PROHIBITED USES
The website may not be used:
- for unlawful activities
- to infringe the rights of third parties
- to introduce or transmit malicious software
- to collect personal data without authorisation
- to send spam or engage in other forms of misuse
- in any way that may compromise the security or functionality of the website.
SECTION 20 – LIMITATION OF LIABILITY
We make reasonable efforts to ensure the reliable and secure operation of our website, but we cannot guarantee that it will always operate without interruption or technical difficulties.
The liability of EXCLUSIVE CARBON CASE d.o.o. is limited only to the extent permitted by applicable law.
Nothing in these Terms limits or excludes any consumer rights that cannot legally be limited or excluded by contract.
SECTION 21 – SEVERABILITY
If any provision of these Terms is found to be void, invalid or unenforceable, this will not affect the validity of the remaining provisions.
SECTION 22 – TERMINATION OF USE
Users may stop using the website at any time.
We may restrict or prevent access to the website for users who violate these Terms, applicable law or the rights of third parties.
Termination of access to the website does not affect rights and obligations arising from contracts already concluded.
SECTION 23 – ENTIRE AGREEMENT
These Terms, together with any other rules and policies expressly referred to herein, govern the use of the online store and the purchase of our products.
Nothing in these Terms affects mandatory rights granted to consumers under applicable law.
SECTION 24 – GOVERNING LAW AND DISPUTE RESOLUTION
These Terms and contracts concluded through the online store are governed by the laws of the Republic of Croatia.
In the event of a dispute, EXCLUSIVE CARBON CASE d.o.o. and the consumer will first attempt to resolve the matter amicably.
If an amicable resolution is not possible, the competent court will be determined in accordance with applicable law.
SECTION 25 – CHANGES TO THESE TERMS
EXCLUSIVE CARBON CASE d.o.o. reserves the right to amend or supplement these Terms in accordance with applicable law.
Any changes will be published on this website and will apply from the date of publication unless otherwise stated.
An order will be governed by the Terms that were in force at the time the contract was concluded or the order was confirmed.

ODJELJAK 2 – OPĆI UVJETI
Zadržavamo pravo odbiti ili ograničiti narudžbu u slučajevima dopuštenima zakonom, osobito u slučaju sumnje na zlouporabu, prijevaru, netočne podatke ili druge okolnosti koje mogu onemogućiti uredno izvršenje narudžbe.
Nije dopušteno bez našeg prethodnog pisanog dopuštenja kopirati, preprodavati ili komercijalno iskorištavati sadržaj internetske stranice ili bilo koji njezin dio.
ODJELJAK 3 – TOČNOST INFORMACIJA
Nastojimo da sve informacije objavljene na internetskoj stranici budu točne, potpune i ažurne.
Unatoč tome, moguće su nenamjerne pogreške ili propusti. Zadržavamo pravo ispraviti takve pogreške čim ih uočimo.

ODJELJAK 4 – CIJENE
Cijene proizvoda prikazane su na internetskoj stranici uz pojedini proizvod ili se, kod proizvoda koji se izrađuju prema individualnim zahtjevima kupca, utvrđuju prema odabranoj konfiguraciji i specifikaciji narudžbe.
Cijene se mogu mijenjati bez prethodne obavijesti, ali promjena cijene nakon potvrde narudžbe ne utječe na već potvrđenu narudžbu.
Cijene proizvoda nisu automatski prilagođene pojedinom kupcu na temelju njegovih osobnih podataka ili ponašanja na internetskoj stranici.
Svi eventualni dodatni troškovi koji se mogu unaprijed izračunati bit će kupcu prikazani prije konačne potvrde narudžbe.
ODJELJAK 5 – PROIZVODI I USLUGE
Određeni proizvodi dostupni su isključivo putem internetske trgovine i mogu biti dostupni u ograničenim količinama.
Većina AccordCase proizvoda izrađuje se nakon zaprimljene narudžbe prema specifikaciji, odabiru i individualnim zahtjevima kupca. Ovisno o proizvodu, kupac može odabrati model, dimenzije, boju, završnu obradu i druge karakteristike.
Proizvodi iz kategorije OUTLET u pravilu su unaprijed proizvedeni proizvodi koji nisu izrađeni prema individualnoj specifikaciji konkretnog kupca.
Nastojimo što vjernije prikazati boje, materijale i izgled proizvoda, ali prikaz može u određenoj mjeri ovisiti o postavkama zaslona i uređaja kupca.
Zadržavamo pravo prestati nuditi pojedini proizvod ili ograničiti njegovu dostupnost.
ODJELJAK 6 – NARUDŽBE I PODACI ZA NAPLATU
Kupac je dužan prilikom narudžbe dati točne, potpune i ažurne podatke potrebne za obradu narudžbe, plaćanje i dostavu.
Zadržavamo pravo odbiti ili ograničiti narudžbu ako postoje opravdani razlozi, uključujući pogreške u podacima, nemogućnost izvršenja narudžbe ili sumnju na zlouporabu.
Dostupni načini plaćanja prikazuju se kupcu tijekom postupka naručivanja.
ODJELJAK 7 – PROIZVODNJA I ISPORUKA
Naši proizvodi izrađuju se ručno.
Očekivani rok proizvodnje i isporuke u pravilu iznosi 15 do 60 dana, ovisno o vrsti proizvoda, specifikaciji i zahtjevima narudžbe.
Troškovi dostave, ako postoje, bit će navedeni kupcu prije konačne potvrde narudžbe.

ODJELJAK 8 – PRAVO NA JEDNOSTRANI RASKID UGOVORA
OUTLET proizvodi
Za proizvode iz kategorije OUTLET, koji su unaprijed proizvedeni i nisu izrađeni prema specifikaciji pojedinog kupca, potrošač ima pravo, bez navođenja razloga, jednostrano raskinuti ugovor sklopljen putem internetske trgovine u roku od 14 dana od dana primitka proizvoda.
Kako bi ostvario pravo na jednostrani raskid, potrošač nas mora obavijestiti o svojoj odluci prije isteka roka od 14 dana.
Za podnošenje zahtjeva kupac može koristiti naš online obrazac:
Kupac može svoju odluku o raskidu dostaviti i drugom nedvosmislenom izjavom poslanom na adresu elektroničke pošte [email protected].
Za raskid ugovora nije potrebno navoditi razlog.
Potrošač je proizvod dužan vratiti bez nepotrebnog odgađanja, a najkasnije u roku od 14 dana od dana kada nas je obavijestio o raskidu ugovora.
Izravne troškove povrata proizvoda snosi potrošač.
U slučaju valjanog jednostranog raskida ugovora vratit ćemo potrošaču primljene uplate bez nepotrebnog odgađanja, a najkasnije u roku propisanom važećim zakonodavstvom.
Povrat uplaćenog iznosa možemo zadržati do trenutka kada nam proizvod bude vraćen ili dok nam potrošač ne dostavi dokaz da je proizvod poslao natrag, ovisno o tome što nastupi ranije.
Potrošač odgovara za umanjenje vrijednosti proizvoda koje je posljedica rukovanja proizvodom izvan onoga što je potrebno radi utvrđivanja njegove prirode, obilježja i funkcionalnosti.
Proizvodi izrađeni prema specifikaciji kupca
Pravo na jednostrani raskid ugovora u roku od 14 dana ne primjenjuje se na proizvode izrađene prema specifikaciji kupca ili proizvode koji su jasno prilagođeni kupcu.
To se odnosi na AccordCase proizvode koji se izrađuju nakon zaprimljene narudžbe na temelju individualnog odabira, specifikacije ili zahtjeva kupca.
Ovo isključenje prava na jednostrani raskid ne utječe na zakonska prava potrošača u slučaju materijalnog nedostatka, neispravnog proizvoda ili proizvoda koji nije isporučen u skladu s narudžbom.
ODJELJAK 9 – MATERIJALNI NEDOSTACI I REKLAMACIJE
EXCLUSIVE CARBON CASE d.o.o. odgovara za materijalne nedostatke proizvoda u skladu s važećim propisima Republike Hrvatske.
Radi što bržeg rješavanja reklamacije, molimo kupca da vidljive nedostatke, oštećenja ili pogrešno isporučen proizvod prijavi u roku od 8 kalendarskih dana od primitka proizvoda.
Reklamacija se može poslati na adresu e-pošte [email protected], uz broj narudžbe, opis problema i, kada je moguće, fotografije proizvoda.
Navedeni rok od 8 dana predstavlja preporučeni rok za brzo rješavanje reklamacije i ne ograničava zakonska prava potrošača koja proizlaze iz odgovornosti za materijalne nedostatke.
Zakonska odgovornost za materijalne nedostatke primjenjuje se u skladu s važećim propisima, uključujući propisano minimalno trajanje odgovornosti od dvije godine za potrošačke ugovore.
U slučaju opravdane reklamacije potrošač ima prava koja mu pripadaju prema važećim propisima, uključujući, ovisno o okolnostima i zakonskim uvjetima, pravo na popravak ili zamjenu proizvoda, sniženje cijene ili raskid ugovora.
ODJELJAK 10 – OŠTEĆENJE TIJEKOM DOSTAVE
Kupac je prilikom preuzimanja dužan pregledati vanjsko stanje pošiljke.
Ako je na pakiranju vidljivo oštećenje, molimo kupca da ga odmah prijavi dostavljaču i, ako je moguće, fotografira oštećenje.
Ako kupac zbog vidljivog oštećenja odbije preuzeti pošiljku, potrebno je ispuniti odgovarajući zapisnik dostavne službe i obavijestiti nas na [email protected].
Ovaj postupak ne ograničava zakonska prava potrošača.
ODJELJAK 11 – PISANI PRIGOVOR POTROŠAČA
Potrošač može podnijeti pisani prigovor:
- osobno u poslovnim prostorijama društva EXCLUSIVE CARBON CASE d.o.o.
- poštom na adresu sjedišta društva
- elektroničkom poštom na [email protected]
Primitak pisanog prigovora potvrdit ćemo bez odgađanja.
Na pisani prigovor odgovorit ćemo u pisanom obliku najkasnije u roku od 15 dana od dana njegova zaprimanja, uz jasno očitovanje prihvaćamo li osnovanost prigovora.
Evidenciju pisanih prigovora vodimo i čuvamo u skladu s važećim propisima.
ODJELJAK 12 – IZVANSUDSKO RJEŠAVANJE POTROŠAČKIH SPOROVA
Ako potrošač nije zadovoljan odgovorom na pisani prigovor, može pokrenuti postupak alternativnog rješavanja potrošačkog spora pred jednim od nadležnih tijela za alternativno rješavanje potrošačkih sporova u Republici Hrvatskoj.
Informacije o nadležnim tijelima i načinu pokretanja postupka dostupne su na službenim stranicama nadležnih državnih tijela.
ODJELJAK 13 – JAMSTVO I POSTPRODAJNE USLUGE
Zakonska prava potrošača u vezi s materijalnim nedostacima proizvoda ostvaruju se u skladu s važećim propisima Republike Hrvatske.
Ako za pojedini proizvod postoji dodatno komercijalno jamstvo, njegovi uvjeti i trajanje bit će jasno navedeni uz proizvod ili u pripadajućoj dokumentaciji.
Za pitanja vezana uz korištenje proizvoda, održavanje, rezervne dijelove ili druge oblike postprodajne podrške kupac nam se može obratiti na [email protected].
ODJELJAK 14 – ALATI I USLUGE TREĆIH STRANA
Na internetskoj stranici možemo omogućiti pristup određenim alatima ili uslugama trećih strana.
Na korištenje takvih usluga mogu se primjenjivati posebni uvjeti njihovih pružatelja, na koje nemamo utjecaj.
ODJELJAK 15 – POVEZNICE NA TREĆE STRANE
Naša internetska stranica može sadržavati poveznice na internetske stranice trećih strana.
Ne odgovaramo za sadržaj, proizvode, usluge ili pravila poslovanja takvih stranica. Preporučujemo da prije korištenja njihovih usluga pregledate njihove uvjete i pravila privatnosti.

Ako nam korisnik dobrovoljno dostavi ideje, prijedloge, povratne informacije ili drugi sadržaj, takav sadržaj ne smije kršiti prava trećih osoba niti sadržavati nezakonit ili štetan sadržaj.

Podaci potrebni za obradu narudžbe, plaćanje, dostavu i komunikaciju s kupcem obrađuju se u skladu s važećim propisima o zaštiti osobnih podataka.
ODJELJAK 18 – POGREŠKE I PROPUSTI
Možemo ispraviti pogreške ili netočnosti u opisima proizvoda, cijenama, promocijama, dostupnosti i drugim informacijama.
Ako pogreška utječe na već poslanu narudžbu, kupca ćemo o tome obavijestiti i postupiti u skladu s važećim propisima.
ODJELJAK 19 – ZABRANJENE UPORABE
Zabranjeno je koristiti internetsku stranicu:
- za nezakonite aktivnosti
- za kršenje prava trećih osoba
- za unošenje ili prijenos zlonamjernog softvera
- za neovlašteno prikupljanje osobnih podataka
- za slanje neželjenih poruka ili druge oblike zlouporabe
- na način kojim se može ugroziti sigurnost ili funkcionalnost stranice.
ODJELJAK 20 – OGRANIČENJE ODGOVORNOSTI
Nastojimo osigurati pouzdan i siguran rad internetske stranice, ali ne možemo jamčiti da će njezin rad u svakom trenutku biti potpuno neprekinut ili bez tehničkih poteškoća.
Odgovornost EXCLUSIVE CARBON CASE d.o.o. ograničena je samo u mjeri u kojoj je takvo ograničenje dopušteno važećim propisima.
Ništa u ovim Uvjetima ne ograničava niti isključuje prava potrošača koja se prema zakonu ne mogu ugovorno ograničiti ili isključiti.
ODJELJAK 21 – DJELOMIČNA NIŠTETNOST
Ako se neka odredba ovih Uvjeta utvrdi ništetnom, nevažećom ili neprovedivom, to neće utjecati na valjanost ostalih odredbi.
ODJELJAK 22 – PRESTANAK KORIŠTENJA
Korisnik može u bilo kojem trenutku prestati koristiti internetsku stranicu.
Možemo ograničiti ili onemogućiti korištenje stranice korisniku koji krši ove Uvjete, primjenjive zakone ili prava trećih osoba.
Takav prestanak korištenja internetske stranice ne utječe na prava i obveze koje proizlaze iz već sklopljenih ugovora.
ODJELJAK 23 – CJELOVITOST UVJETA
Ovi Uvjeti, zajedno s drugim pravilima i politikama na koje se izričito pozivaju, uređuju korištenje internetske trgovine i kupnju naših proizvoda.
Ništa u ovim Uvjetima ne utječe na obvezna prava koja potrošaču pripadaju prema važećim propisima.
ODJELJAK 24 – MJERODAVNO PRAVO I RJEŠAVANJE SPOROVA
Na ove Uvjete i ugovore sklopljene putem internetske trgovine primjenjuje se pravo Republike Hrvatske.
U slučaju spora, EXCLUSIVE CARBON CASE d.o.o. i potrošač nastojat će spor riješiti mirnim putem.
Ako mirno rješenje nije moguće, za rješavanje spora nadležan je sud određen prema važećim propisima.
ODJELJAK 25 – IZMJENE UVJETA
EXCLUSIVE CARBON CASE d.o.o. zadržava pravo izmijeniti ili dopuniti ove Uvjete u skladu s važećim propisima.
Sve izmjene bit će objavljene na ovoj internetskoj stranici i primjenjivat će se od dana njihove objave, osim ako je drukčije navedeno.
Na narudžbu se primjenjuju Uvjeti koji su bili važeći u trenutku sklapanja ugovora odnosno potvrde narudžbe.
